Project Description

Samson Maritime Limited is one of the established players in the business of providing offshore logistics support services to the Oil & Gas sector in India. The Samson Group has a fleet of 19 vessels which comprise Anchor Tugs, Supply Vessels, Harbor tugs, Ocean going Tugs and utility boats / vessels which are deployed in:

- Offshore Logistics Support and Supply Services;
- Single Point Mooring (SPM) – Operations & Maintenance;
- Lighterage and Harbor Operations; and
- Diving & Salvage Services.

The project comprises a corporate investment for part financing Samson Maritime Limited’s (Samson or the company) capital expenditure plan for the purchase of new build and second hand Off-shore supply vessels (OSV).

Overview of IFC's Scope of Review

Samson Maritime Limited (Samson or the company) is one of the established players in the business of providing offshore logistics support services to the Oil & Gas sector in India. The review of this project consisted of appraising technical, environmental and social information submitted by the company including a review of:

- Samson’s Safety and Environment Management System Manual;
- Draft Human Resource Manual;
- Safety of Life at Sea (SOLAS);
- incident monitoring/investigation/closure process records;
- safety equipment on board;
- testing/drill logs;
- drill schedule;
- employment letters;
- safety committee meeting records;
- Shipboard oil pollution emergency plan; and
- internal and third party audit reports.

The appraisal team met with and interviewed the sponsor, corporate and site, vessel operations managers, and EHS managers and visited its operating vessel.

E & S Project Categorization and Applicable Standard

While all Performance Standards (PS) are applicable to this investment, IFC’s environmental and social due diligence indicates that the investment will have impacts which must be managed in a manner consistent with the following Performance Standards:

- PS1: Social and Environmental Assessment and Management System;
- PS2: Labor and Working Conditions; and
- PS3: Pollution Prevention and Abatement

The project does not involve any land acquisition and involuntary resettlement, and no impact on indigenous people or cultural property expected, nor is it expected to have any impacts on natural habitats, forests, or protected or sensitive areas.

This is a Category B project because a limited number of specific environmental and social impacts may result which can be avoided or mitigated by adhering to generally recognized performance standards, guidelines or design criteria. Further, it is possible to readily design and implement engineering and management measures to mitigate the adverse impact. The key social, environmental, health and safety impacts associated with the project will include:

- Environmental, Health and Safety Management Systems;
- Labor working conditions, including occupational health and safety;
- Vessel safety and pollution control; and
- Oil/chemical spill containment and recovery.

Environmental and Social Mitigation Measures

The company has presented plans to address these impacts to ensure that the proposed project will, upon implementation of the specific agreed measures, comply with applicable environmental, health and safety and social requirements, including:

- international maritime standards under MARPOL, SOLAS, and IMO; Indian Merchant Shipping Laws and Rules and environmental, health and safety laws; and
- the IFC Social and Environmental Performance Standards.

The information about how these potential impacts will be addressed by Samson is summarized in the paragraphs that follow.

- Environmental, Health and Safety Management Systems

The company’s sponsor and management are sensitive to environmental, social, occupational health and safety (EHS) aspects of their operations. The company has implemented a safety and environment management system (SEMS) based on International Management Code for Safe Operation of Ships and for Pollution Prevention (ISM Code). The management system supports Safety of Life at Sea (SOLAS), Marine Pollution Prevention (MARPOL) standards and applicable IMO conventions. The company adheres to SOLAS requirements for vessels less than 500 GRT. The company will further upgrade its safety management system within a timeframe agreed with IFC. Further, the company will, within a timeframe agreed with IFC implement an environment management system based on ISO 14001 standards with IFC’s Performance Standards incorporated. Under the SEMS, a well defined organizational structure and processes are in place and qualified professionals have been appointed. Samson already has internal on-board safety committees for all its vessels, which meet every month. Samson has processes for annual internal safety and environmental audits and annual third party audits. The company has procedures for monitoring and periodic reporting of safety and environmental information to Senior Management.

- Labor and Working Conditions

Samson engages about 300 personnel in its operations including 100 shore based staff. Vessel based crew is typically on short term contracts. Conditions of employment as also wages and benefits are communicated to employees/contract workers/pilots/masters and crew in the appointment letter or contracts. Towards further upgrading management of human resources (HR), the company has commenced work to develop and implement a documented HR Policy and Manual, a draft of which has been prepared and includes procedures on:

- recruitment, induction and training;
- leaves and attendance;
- entitlement and benefits;
- health and safety;
- employee conduct and discipline; and
- separation.

Samson will, as part of the HR policies articulate and communicate to all personnel:

- an equal opportunities and non discrimination policy;
- a detailed disciplinary procedure; and
- a grievance redress procedure.

The company will, within a timeframe agreed with IFC, complete development and implementation of the HR policies and procedures manual, which will be consistent with IFC’s PS2 provisions.

Samson has an effective employee health and safety program, much of which is detailed in stringent written work procedures. Personal protective equipment is provided, as are instructions in its use. Seafarers and shore staff undergo periodic medical examinations. Samson crew complete basic safety training, and officers undertake advance courses in fire fighting, life saving and medical first aid. Regular mock drills for fire, spill response, and medical evacuation are conducted on vessels. Accidents/incidents/near misses events are documented and analyses of causes are conducted to prevent reoccurrence in the future.

- Vessel Safety and Pollution Control

All of Samson’s ships have certificates issued by regulatory authorities appropriate to their tonnage indicating compliance with Indian and international safety and pollution prevention requirements. Ships are regularly inspected, and all inspections are up to date. Ship-generated solid waste (engine maintenance wastes, plastics, glass, etc.) and oily waste are segregated and periodically brought ashore to be disposed at authorized port reception facilities in a manner consistent with Indian and MARPOL requirements. The SEMS has waste management procedures that refer to appropriate MARPOL requirements. The company will, to further upgrade its waste management procedures, develop and implement, within a timeframe agreed with IFC, detailed standard operating procedures for waste management in accordance with MARPOL provisions.

- Oil/Chemical Spill Containment and Recovery

Samson has implemented a Shipboard Oil Pollution Emergency Plan detailing oil/chemical spill contingency plans and procedures as part of the ISM code based SEMS, which provides for shipboard and shore side response in the event of a spill resulting from Samson’s operations. In addition, the company has prepared Emergency Management Plan (EMP) that covers the procedures for responding to collision, grounding, fire, abandon ship, personnel overboard, personnel injury, illness, flooding, air diving, and oil spill or pollution events. The company’s ships are suitably equipped with spill clean-up and fire fighting equipment consistent with the emergency response requirements. On-board equipment is periodically tested, and the company’s crews are trained in emergency response by authorities. There have been no material spill incidents from Samson’s operations.

Stakeholder Engagement

Owing to the nature of Samson’s activities, no specific local communities are directly affected by risks or impacts from this project. As a result, no formal information dissemination activities have been undertaken. Notwithstanding, and as part of the ISO 14001 certification process, which the company proposes to commence, Samson will be establishing procedures for communication of the environmental aspects to external interested parties. In addition, the company will establish and maintain procedures for receiving, documenting and responding to concerns from any external interested parties relating to the project.

Further, the company will disclose on its website (www.samsonmaritime.com), the measures it proposed to implement so as to conduct its operations in accordance with IFC’s Performance Standards.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. Since 2012, IFC's Financial Intermediary clients applying the Performance Standards are required to develop External Communications Mechanisms to receive and review inquiries or complaints from any interested party regarding the E&S risks and impacts of their operations.

For IFC projects that are active or under consideration, individual(s), or their authorized representative(s), who allege they have been or will be adversely affected by E&S risks or impacts arising from IFC's clients' business activities, may submit a complaint to IFC directly for consideration. When receiving an E&S complaint, IFC engages with complainants and works with its clients to find solutions to E&S concerns as quickly and efficiently as possible.

IFC complaint response is separate from and complementary to IFC’s clients’ project level grievance mechanisms and IFC’s Independent Accountability Mechanism (CAO). Lodging a complaint directly with IFC does not, at any time, restrict access to CAO.

Affected communities have unrestricted access to the Compliance Advisor Ombudsman (CAO), the independent accountability mechanism for IFC and MIGA. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
