Environmental Review Summary (ERS)

Project Name AEF-UGANDA: Bulangiti Farm/Mosa Court Apartments

1. This project involves the development of an extension, through refurbishment of 16 apartments and construction of a 25 unit apartment block, of the existing 12 Mosa Court apartments in Kampala. The complex will be equipped with a swimming pool, health club, staff quarters, roads and a support facility on a 3 acre site. Total project cost is estimated at US$2.6 million of which AEF has been approached to provide financing totaling US$800,000.

2. This is a category B project according to IFC’s environmental review procedure because specific impacts may result which can be avoided or mitigated by adhering to generally recognized performance standards, guidelines or design criteria. The review of this project consisted of the appraisal of technical and environmental information submitted by the project sponsor and completed by IFC’s Environment Department staff. The key environmental, health and safety issues considered in this project include:

· land use;
· sewage treatment\disposal;
· liquid and solid waste;
· CFC-free cold storage and air conditioning;
· fire safety measures; and
· employee training and general safety.

The sponsor has presented information to address these issues and demonstrate that the proposed project will comply with applicable governmental and World Bank requirements. The information provided about how these potential impacts are addressed in the development of the project is summarized in the paragraphs that follow.

3. The project has been deemed consistent and in compliance with local zoning laws, land use practices and local sanitation and environmental requirements. The site has been a residential rental complex since 1954 and will continue to remain so as part of this refurbishment and expansion scheme. The sponsors have indicated that there is no public objection to the project, and the Kampala City Council has approved the plans and designs.

4. Sewage and all liquid waste, from all point sources (e.g., kitchen and laundry operations), will be disposed of directly to the Kampala City Council sewer system. Solid waste from all point sources will be stored in waterproof bins and periodically disposed of by the Kampala City Council at the Gayaza Road landfill, as per local laws and regulations.

5. Water is supplied through the city mains. Supply at the site has been tested and conforms with WHO standards for drinking water. The complex will be connected to the national grid for power supply. A backup diesel generator has been installed, with secondary containment to prevent accidental leaks.

6. The sponsors architects have confirmed, in writing, that the project is being designed to comply with World Bank Fire Safety guidelines. In addition, as a condition of IFC’s loan disbursement, the sponsor will have a desk review of project design completed by an independent fire safety expert/firm.

7. Employees will be provided with appropriate safety equipment, and periodic training, including emergency response preparedness.

8. The complexes refrigeration and ac units will be CFC-free. No hazardous substances or wastes will be generated from operations.

9. IFC will ensure ongoing compliance with World Bank environmental, health and safety policies and guidelines during the life of the project by evaluating monitoring reports submitted annually to IFC by Bulangiti Farm/Mosa Court and by conducting periodic supervisions.

10. Based on its review of available information regarding potential environmental impacts and proposed mitigation measures, IFC concludes that the proposed project is being designed to meet Government of Uganda requirements, and World Bank policies, and environmental, health and safety guidelines.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. Since 2012, IFC's Financial Intermediary clients applying the Performance Standards are required to develop External Communications Mechanisms to receive and review inquiries or complaints from any interested party regarding the E&S risks and impacts of their operations.

For IFC projects that are active or under consideration, individual(s), or their authorized representative(s), who allege they have been or will be adversely affected by E&S risks or impacts arising from IFC's clients' business activities, may submit a complaint to IFC directly for consideration. When receiving an E&S complaint, IFC engages with complainants and works with its clients to find solutions to E&S concerns as quickly and efficiently as possible.

IFC complaint response is separate from and complementary to IFC’s clients’ project level grievance mechanisms and IFC’s Independent Accountability Mechanism (CAO). Lodging a complaint directly with IFC does not, at any time, restrict access to CAO.

Affected communities have unrestricted access to the Compliance Advisor Ombudsman (CAO), the independent accountability mechanism for IFC and MIGA. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
