Intellicare prefers to rent office space, owning two small offices, and does not intend to acquire land or purchase property for its offices or clinics. Thus PS5: Land Acquisition and Involuntary Resettlement does not apply to the Project. PS6: Biodiversity Conservation and Sustainable Management of Living Natural Resources, PS7: Indigenous Peoples and PS8: Cultural Heritage do not apply given the urban focus.

Environmental and Social Assessment and Management Systems: Each company has a set of policies and procedures on environmental health and safety that respond to regulatory requirements.  For both Asalus and Avega, the environmental and social management system is focused on the priorities for an HMO, including regulatory requirements related to occupational health and safety and emergency response. For Aventus, the management system is focused on managing environmental and social risks in the clinics, including environmental health and safety and waste management. The Project is not expected to add any physical footprint to the current activities; therefore, no additional environmental and social risks are expected.

Management Programs and Organization: All three companies have offices or clinics in rented commercial buildings in which the fire drills are organised by the building maintenance company on a quarterly basis. All three companies are responsible for managing fire prevention and maintenance of fire safety equipment. As each company expands and seeks new office or clinic space, they use a checklist, which includes verification of functional fire exits. 

Aventus has a procedure for segregating, containing and minimising risk from disposal of all waste at their clinics. This procedure, updated in January 2017 clearly describes the segregation and handling of waste as stipulated by the national regulations.

As ESAP item #1, the Sponsor will develop an environmental and social management framework that incorporates policies and guidance for Intellicare, requiring each company to adopt risk assessment procedures and management programs appropriate to their line of business. The framework will include i) life and fire safety (“LFS”) provisions for prospective offices and clinics, as well as  for existing buildings; ii) management of Occupational Health and Safety elements; and iii) handling of solid waste, in particular medical waste including storage points and transportation routes. Specific protocols will be aligned with the WBG/IFC EHS Guidelines for Health Care Facilities. The framework will also provide a monitoring and reporting mechanism to measure effectiveness of these programs.

Organizational Capacity and Competency: Asalus and Avega each have a committee on Health, Environment, Safety and Security (“HESS”), with representatives from each department. The committee meets once a month to create policies mandated by government regulations and review quarterly safety inspections. This committee is responsible for life and fire safety management. All companies are required by law to have a Pollution Control Officer (“PCO”) and a safety officer. At Aventus, the Pollution Control ensure that all permits are secured, including for hazardous waste, radiology and laboratories, and prepare quarterly reports to the Department of Environment and Natural Resources (“DENR”). Safety Officers are responsible for fire safety management and maintenance within the clinic.

Safety seminars are organised to train staff and staff participate in the fire drills organised by the building maintenance company.

Emergency Preparedness and Response: All three companies have procedures, with allocated roles and responsibilities, for responding to earthquake or fire emergencies. Drills are performed quarterly and corrective actions are implemented where deficiencies are identified.

Monitoring and Review: The companies monitor and review implementation of medical and occupational health and safety requirements, based on local law.

    Human Resources Policies and Procedures and Terms of Employment: Intellicare has over 2,700 employees, of which around 1,800 are in Asalus, around 200 in Avega and over 700 in Aventus. More than 50% of all employees at all three companies are women. Each company has an employee manual or code of conduct which is disseminated to the staff at the start of their employment. While the Aventus employee manual provides information on the terms of employment and company rules, the Avega and Asalus codes of conduct only provide information on the company rules. Asalus has a sexual harassment policy which is administered by the Committee on Decorum. The HR policies, and any changes therein, are disseminated to staff by the HR Committee through the orientation training, online and on noticeboards. All employees are full time and receive a permanent contract upon completion of a successful 6 month probation period. A small percentage of staff are required to work overtime, usually only if staff are on holiday.

Workers Organization: While employees are not members of any unions, such is not restricted.

Non-discrimination and Equal Opportunity: While the HR policy does not explicitly refer to non-discrimination and equal opportunities, Intellicare does include such statements in their employment adverts.

Retrenchment: While the Sponsor intends to achieve efficiencies within Intellicare, they expect that continuing growth of the companies will absorb any excess staff and avoid retrenchment. 

Grievance Mechanism: Intellicare has formed a Human Resource Committee that is intended to openly discuss staff issues and concerns and arbitrate grievances and complaints. Staff can report grievances to their supervisor or write to the HR committee. In the code of disciple, however, the grievance mechanism refers to addressing disciplinary issues.

As ESAP item # 2 the Sponsor will develop a Group HR framework that requires all three companies to have HR management systems that inform staff of their employment terms and working conditions, include policies on non-discrimination and equal opportunity and provide a formal transparent mechanism that enables staff to raise grievances anonymously without risk of reprisals, and receive timely feedback from the appropriate level of management.

Occupational Health and Safety (“OHS”): In accordance with regulatory requirements, each company has a Health, Environment, Safety and Security (“HESS”) committee, which is responsible for occupational health and safety. The primary OHS risks are associated with the hazards that may affect employees in the clinic, as well as workers involved in handling hazardous waste. Aventus has operational health, safety and environment guidelines relating to training of all employees and contractors on safety, health and environmental matters, including aspects of hazard identification, safe operating and materials handling procedures, safe work practices, basic emergency procedures and special hazards unique to their jobs, however detailed procedures would need to be developed to be aligned with the IFC/WBG EHS Guidelines for Health Care Facilities (see ESAP item # 1). 

Resource efficiency: All companies make efforts to reduce the use of paper and enhance energy efficiency. The company is undertaking a process of replacing light fittings with new LED light bulbs. The consumption of energy and water are related to normal office operations, considered domestic usage and with limited impacts.

Hazardous Waste Management: Medical waste is collected from the mobile units at the end of each day and stored in the nearest clinics until removed by collectors accredited by DENR. Waste is collected at the larger clinics in Makati twice a week and twice a month in the smaller clinics. DENR undertakes regular spot checks of clinics and vans.  For Aventus, the management system framework (see ESAP item # 1) will also address management of hazardous waste at storage points and transportation routes. As the clinics are in office and shopping locations, the procedures require more specific protocols that should be aligned with the waste management section of the WBG/IFC EHS Guidelines for Health Care Facilities.

   Life and fire safety elements are managed at the offices and clinics by having basic emergency response plans, maintenance plans, and training employees on how to respond in case of emergency. As described in ESAP #1, the Company will manage LFS risks as part of the environmental and social management framework. In particular, for LFS, per ESAP #3, the Company will define a LFS policy and criteria for the selection of prospective offices and clinics, considering occupancy and means of egress, as well as systems for fire prevention, detection and suppression. The Company will ensure proper coordination with the buildings maintenance companies where the clinics are located. For existing buildings, the Company will review current procedures and emergency response plans for all of its facilities. Emergency plans will respond to the needs of life and fire safety requirements and include training on emergency evacuation, use of fire equipment, and other applicable aspects identified in the planning process.

Security services are provided by contractors and Asalus and Avega have service level agreements relating to the training, roles and responsibilities of guards.

  All companies have an external complaints mechanism available for customers, and is also available to the general community; however the impacts on communities are quite limited. In Asalus and Avega, customers/patients would normally channel complaints through their HR team which would address the Account Management Team. Alternatively, complaints may be received through Patient Relationship Officers (“PRO”) in hospitals. Complaints are recorded and escalated if they cannot be handled by the PRO. The vans and clinics have several avenues for complaints, including through Facebook, and a hotline number on vans.
