While all Performance Standards are applicable to this investment, IFCs environmental and social due diligence indicates that the investment will have impacts which must be managed in a manner consistent with the following Performance Standards. PS5: Land Acquisition and Involuntary Resettlement is not applicable as Yangxiang leases land from Yajishan State Forest Farm in Guigang, Guangxi, and partners with other private parties who hold leases of previously idle agricultural land for its new breeding farm expansion in Shenyang. All the land are leased on mutually agreeable term. PS7 Indigenous People is not applicable as no indigenous people are impacted by its operations. PS8 Cultural Heritage is not applicable as no sites, structures or resources with archeological, paleontological, historical, or religious significance are in the areas of Yangxiang’s operations.

The Project is categorized as B. The key E&S issues identified during the IFC E&S due diligence activities include the following: 1) the need for the Company to develop and implement a corporate-wide environmental and social management system (ESMS); of particular importance is how this system is expanded – and staffed – to allow for the identification and then management of E&S risks and impacts associated with Yangxiang’s contract farms; 2) community engagement especially with regard to Yangxiang’s operations through their contract farms; 3) the management of OHS issues in relation to contractor workers.

IFC's appraisal considered the environmental and social management planning process and documentation for the project and gaps, if any, between these and IFCs requirements. Where necessary, corrective measures, intended to close these gaps within a reasonable period of time, are summarized in the paragraphs that follow and (if applicable) in an agreed Environmental and Social Action Plan (ESAP). Through the implementation of these measures, the project is expected to be designed and operated in accordance with Performance Standards objectives. The key E&S issues identified during the IFC E&S due diligence activities include the following: 1) the development and implementation of the environmental and social management system (ESMS), particularly with respect to how it is expanded – and staffed – to include newly commissioned operations and how it is integrated with contract farm management; 2) community engagement especially with regard to Yangxiang’s operations related to contract farms. Specific concerns related to waste management, typical of operations in this sector, are addressed through the regulatory required construction and operation of biogas facilities and use of stabilized wastes as fertilizers, and for irrigation (after testing is done to ensure that the quality of liquid effluents meet discharge standards). Yangxiang has a dedicated unit managing and operating these facilities. Yangxiang’s feed mills overall are generally simple operations and are well managed facilities with limited environmental and social impacts.
As such the proposed project is categorized as B due to the fact that limited environmental and social impacts are expected. These impacts can be avoided or mitigated by adhering to recognized performance standards, procedures, guidelines and design criteria as described in the following sections. This categorization is in accordance with other similar type of projects within this sub-sector. The project is designed to avoid, minimize and manage environmental and social risks and impacts of the company’s operations in compliance with local legal and regulatory requirements, applicable IFC Performance Standards and World Bank Group (WBG) General and sector specific (mammalian livestock production) Environmental, Health and Safety (EHS) Guidelines. IFC’s Good Practice Note on Animal Welfare and its applications to Yangxiang’s operations has also been assessed during the appraisal.

Policy: the company’s corporate culture emphasizes employees’ personal safety, fire safety, biosecurity, and the business’ operational environment including the company’s relationship with neighboring communities. While this culture certainly encompasses elements of E&S policies as required in Performance Standard (PS) 1, it needs to be expanded to fully articulate Yangxiang’s commitment and objectives in achieving E&S performance as required by IFC’s Performance Standards. This is addressed in the Environmental and Social Action Plan (ESAP) under ESAP item #1.



Environment and social assessment: Yangxiang follows the standardized Chinese regulatory requirements when it comes to new construction of its facilities, i.e., hiring qualified 3rd party agency to conduct an environmental impact assessment (EIA), and upon receiving approvals from the local Environmental Protection Agency (EPA) on this assessment, starting the construction. Surveys and consultations of the neighboring affected communities are also conducted as part of the EIA. Typical impacts associated with these types of operations, and that are described in the EIA include wastewater (mitigated with regulatory required wastewater treatment facilities), odor (mitigated with good management of waste and de-sulfurization of biogas), noise (mitigated with good engineering design and siting selection of the pig farms), and solid waste (mitigated with good waste management practices). During the construction phase, Yangxiang works with construction contractors to ensure that the feedback from the EIA process are carefully incorporated to minimize environmental impacts. After the construction is completed, a temporary operational permit has to be obtained from the local EPA to initiate 3-6 months of pilot operation. The actual operation can only start after the EPA issues approval based on the pilot results and issues the permit for wastewater discharge.



Management programs, organizational capacity and competency: Yangxiang presently doesn’t have a corporate wide environmental and social management system (ESMS), although it does have an Environmental Protection (EP) unit within the pig farming division of the company. The main responsibility of this unit is overseeing the operation of the wastewater treatment (WWT) facilities of the breeding farms. Specific activities include equipment maintenance, organic fertilizer production and transportation, effluent testing and monitoring, the management of the tree nursery where the treated effluents are eventually discharged (i.e., for irrigation), and training of employees to undertake such aspects. The EP unit is currently headed by a veterinarian-trained vice manager staffed with 25 employees (with additional 25 people to be hired for the expansions of breeding farms in Guangxi). Detailed management programs are made on a yearly basis and reviewed monthly, with measurable targets, approaches to targets and responsible parties being clearly
laid out. It is also in charge of promoting and implementing of an environmental management system, with the goal of having the pig farming division certified for ISO 14001 by the end of 2016.



Yangxiang has an occupational health and safety (OHS) policy and standardized OHS procedures both for pig farming and for the feed mill division. All OHS related matters are managed by Human Resources (HR) department.

There are 19 pig feed subsidiaries under Yangxiang with differing levels of control (ranging from 100% to 40% shareholding). Many of these feed mills had/have received one or more than one internationally recognized certifications, including ISO 9001, ISO 14001, ISO 22000, and HACCP. As mentioned earlier, Yangxian was the first Chinese feed company to obtain both ISO9001 and ISO14001 certifications in the sector. Standardized corporate OHS procedures apply to all feed mills regardless of certification status, and are required of all Yangxiang employee. During the site visit, feed mills visited were observed to be well managed facilities with safety signs clearly in display, clean shop floors, well laid out and organized, and with no visible signs of dust accumulation.



E&S management at construction sites: Yangxiang has detailed procedures on safety management at construction sites. Construction contractors are selected based on their previous record, including if they have had known disputes with rural labors hired over timely payment, an issue quite common among construction contractors in China. Safety-related clauses are included in the construction contract, along with an earmarked safety management budget. During the construction phase, the safety management team appointed by Yangxiang conducts monthly inspection, with daily safety briefing given by safety management personnel. Safety-related non-compliance are punished by fine or suspension.



E&S management at contract farms: all the contract pig farms are required to have waste water treatment facilities (WWTF) that meet Chinese regulatory requirements. Yangxiang inspects the pig houses of its contract farms before sending piglets and will not send piglets to any farms that do not have functional discharging facilities. Furthermore, partly due to biosecurity reasons, pig houses have to be constructed to Yangxiang’s specifications, inspected and accepted by Yangxiang at the completion of construction in order to receive Yangxiang piglets. Yangxiang’s contract farm management specifies siting selection criteria for potential farms, which include environmental and community impacts considerations.



While Yangxiang’s current practices and procedures on contract farm management contain some E&S elements, on an on-going basis it relies on local EPA monitoring of contract farms’ environmental compliance, including that related to effluents. As part of the Environmental and Social Action Plan (ESAP), Yangxiang will therefore be required to fully integrate E&S risk and imp
act identification and management practices and procedures into their existing contract farm management responsibilities.



Emergency Preparedness and Response: the company has detailed emergency preparedness and response procedures covering operations safety-related emergencies typical of a feed mill operation, including fire, explosions caused by boilers, pressure containers and dust, vehicle collision, accidents related to electricity, machinery, building collapse, and fall from height. It also has a general safety management procedure applicable to all Yangxiang operations with requirements on safe driving, electricity usage, fire management, etc. Similar procedures for pig farming division are also in place, covering emergencies related to fire, physical injuries/fatalities, food safety and contagious disease outbreaks.



Monitoring and Review: as part of the WWTF management program, the Environmental Protection unit regularly monitors effluent parameters, including COD, BOD, pH, ammonia nitrogen, TSS, total phosphorous and total nitrogen. On an annual basis targets are set for each of these parameters against regulatory limits and are reviewed monthly to see if targets are met. Sample monitoring results from the breeding farms in 2015 and 2016 were shared with IFC during the appraisal and they were mostly in line with Chinese regulatory requirements for arid irrigation water quality, with the exception of ammonia nitrogen, of which several of Yangxiang’s breeding farms exceeded the limit (30). Other indicators that are monitored include water and electricity usage at pig farms and feed mills, water and electricity usage per ton of wastewater treated, # of safety incidents at WWTF station and in the laboratory (with the target being 0), as well as safety incidents in pig farms and feed mills. At feed mills dust and noise level are monitored.

As of June 2016, the total workforce at Yangxiang was 3,849, including 2,792 men, and 1,057 women. About 1/3 of these workers (1,375) are employed in the pig farming division 17% of the Yangxiang employees possess a college degree or higher.



Yangxiang has written human resources (HR) policies and procedures detailing the hiring process, workers’ compensation, working hours, leave policies, matters related social insurances and occupational health and safety. All the procedures are maintained and updated in the company’s computer system and accessible internally by all the employees. HR policies/procedures are reviewed and approved by middle or senior management as appropriate, and communicated to all employees, with training ensuing if necessary.



Yangxiang has a fair competition and equal opportunity hiring policy and the minimum hiring age is 18. Workers sign a standardized written contract at the time of hiring, The contract clearly lays out the terms of the employment, including if it is an open-ended position or fixed-term position, working hours and leave entitlements, other worker’s benefits including remunerations and social insurances, and occupational health and safety related protections, as well as the terms of terminating the contract. Every new hire goes through a probation period before he/she becomes regular employee.



The majority of the workers are hired from local populations where Yangxiang operates. In 2015, workers at Yangxiang’s Guigang pig farms were paid an average monthly salary of RMB 4586, nearly 4 times higher than the minimum wage of RMB 1210 per month in Guigang as stipulated by the local government. All employees receive social insurances on top of their regular salaries, which covers pension, unemployment, medical, injury, and maternity benefits. Workers are entitled to between 5 to 15 days of annual leave, depending on the length of service with the company. This is in addition to the 11 public holidays in accordance to regulatory requirements.



Workers at pig breeding farms work irregular hours due to the nature of the work especially during the lengthy quarantine period required for gaining access to and working in the farms. As a result, workers normally work for 4 weeks and take 4 days off in a stretch. The company provides free accommodations with modern amenities including TV and free wi-fi access at the farms and subsidized meals in the canteen.



Yangxiang does not restrict workers from the freedom of association. Workers elect representatives to review company’s policies and related updates on remunerations and benefits and to confirm their agreement on such policies/updates by signing on the documents.



Grievance mechanism: workers’ representatives form part of this grievance mechanism. In addition, workers have the following three ways to raise their concerns/grievances: 1) they can speak to the farm head first, and if they are not able to resolve their issue with the farm head, rais
e the issue to HR department; 2) on a semi-annual basis HR interviews every employee and this is an opportunity for employees to raise their concerns; and 3) there is a company-wise WeChat information center/hotline where employees can send confidential WeChat message to this account at any time. Messages sent to this account will be reviewed by a designated personnel and forwarded to relevant department/managers for resolution. This process is communicated to all employees during their onboarding training. This mechanism does not apply to the workers of Yangxiang’s contractors.



Records of grievances raised by Yangxiang employees in 2015 were requested and presented to IFC for review. In total 29 cases were recorded, covering issues ranging from canteen food quality to some supervisor’s attitude towards his/her reports. The grievance mechanism appears to be functional.

Based on IFC review, the company’s approach to managing its own workers is largely consistent with the requirements of this Performance Standards and national law with the exception of its operation of a comprehensive grievance mechanism. Therefore, as part of the ESAP, Yangxiang will be required to extend its grievance mechanism to contract/third-party workers. Yangxiang will also update its grievance procedures to allow workers to provide suggestions/raise concerns anonymously



Occupational health and safety



Yangxiang has an OHS policy and standardized OHS procedures both for pig farming and for feed mill division. All OHS related procedures and monitoring are managed by a designated unit in the HR department. This unit is responsible for making and updating OHS policies, procedures, and ensuring their implementation. At feed mills and pig farms, mill managers and farm managers are directly responsible for day-to-day OHS matters. Safety meetings are called on a monthly basis at all operation units with all staff required to attend. Annual safety targets including zero fatality and 100% safety training coverage of all workers are set and monitored at each operational unit and periodic safety inspections are conducted. OHS trainings are mandatory to all new employees, and trainings are held for all involved when a new technology or new operational process is introduced.



In 2015, the company commissioned Guangxi Institute of Safe Production Research to conduct a safety audit of its Guigang Ruikang Feed Mill. While most of the areas audited passed relevant safety thresholds, dust, noise and illumination levels at some of the testing points exceeded the regulatory limits which are comparable to IFC guideline values.

Fire safety: the local fire safety agency inspects firefighting equipment on an annually basis. Yangxiang conducts fire drills and trainings twice a year. Fire wardens inspect farms and mills every day.



Based on the data provided by Yangxiang, in 2015, with a total of 1017 workers in pig farming division and total working hours of 2538432, Yangxian
g registered 35 non-fatal injuries with total lost workdays of 4786. This resulted in a lost time incident frequency rate (LTIFR) of 13.79, slightly higher than the benchmark US 2013 data of 11.0 for animal production.

Third party workers: Yangxiang hires third party workers through construction contractors, and for loading finished feed packages into transportation trucks at the feed mills. It has detailed OHS procedures, however, these procedures only apply to its own employees. During the site visits, it was observed that at the feed mills contractor workers were loading heavy finished feed packages without any PPE.



As part of the ESAP, going forward Yangxiang will be required to establish policies and procedures for managing and monitoring the performance of such third party employers in relation to the requirements of PS in this regard, especially with regard to OHS issues. Yangxiang will be also required to strengthen its accident/incident investigation system to ensure that all accidents/incidents with or without any loss of work are recorded and reported.

Resource efficiency



In Guigang pig farming operations, water is drawn from a nearby reservoir and no permit is required. In Shenyang, water is drawn from a well onsite and a permit is required. All the farms and mills use power from the national grids. Breeding farms have diesel-powered gensets in case of power outrage. In Shenyang, biomass will be used in the breeding farms under construction to fuel the boilers for heating in the winter.



Yangxiang requires each of its breeding farms to monitor and report water and electricity usages, partly for the purpose of cost control. The EP unit monitors water and electricity used per ton of wastewater treated monthly against an annual target. In its new breeding farms under construction, water will be reused per design to reduce water usage in flushing pig house floors, balancing the needs for sanitation and disease control. These facilities will also incorporate the newest energy efficiency designs developed by South China University in which heat generated from sow lying areas is circulated to piglet pens to keep them warm using a water circulation system. A step ventilation model will be utilized based on precise calculation of temperature and air exchange requirements of different segments of the pig house, resulting in lower power usage by air pumps. In 2016, the company approved “Wastewater Treatment Improvement” as one of its annual technology innovation projects. The project has two objectives: 1) to make the quality of liquid effluents/discharged wastewater comply with the national standards of arid irrigation water; 2) to reduce the wastewater treatment cost to RMB 6.5 per ton and below. The latter is based on water and electricity usage per ton of wastewater treated. Once the new technology is developed and the pilot proves to be successful, it will be gradually expanded to all other WWT facilities under Yangxiang.



Wasterwater treatment: Chinese regulations require that all the pig farms have a WWTF, properly sized to adequately deal with the amounts of wastes to be treated. As noted above, Yangixang has an EP unit under its Pig Farming division whose main responsibilities are the management of wastewater treatment facility and its related operations onsite. Manure is collected and pumped into a pond first for separation of solids and then consequently into different ponds for anaerobic, anoxic and aerobic digestions. The biogas produced from anaerobic digestion is used for cooking or hot water boiler if the quantity is sufficient, and solids are used as raw material for Yangxiang’s organic fertilizer plant. The final treated wastewater (after testing) is used for irrigation on woodland (in Guangxi) or farmland (in Shenyang) located adjacent to the farms. The EP units regularly tests key effluent parameters including BOD, COD, ammonia nitrogen and total phosphorous. The testing results in 2016 showed the parameters at most of the breeding farms in Guangxi meet the standards for Chin
ese arid irrigation water (i.e., for land disposal), with the exception of ammonia nitrogen which exceeded the limit in 5 breeding farms. No monitoring of surface water and ground water quality at the farms have been conducted. This is addressed in the ESAP.



On the contract farm visited, 3-level settlement ponds are built and waste water is eventually discharged into an artificial wetland adjacent to the farms. Local environmental protection agencies are in charge of ensuring that the effluent discharge requirements are met. Yangxiang will not send any piglets to the contract farm if they don’t have functional waste discharging facilities.



As part of its 2016 technology innovation projects, Yangxiang committed to investing in a new technology to collect and to treat all feces generated on its own and contract farms and convert them into organic fertilizers of its own brand. The goal is to achieve 100% collection and treatment rate by June 2017.

Solid waste and hazardous materials: presently pig carcasses are disposed of in designated sealed disposal pits onsite with lime application. As part of the 2016 technology innovation projects, the company is looking into ways to convert pig carcasses into organic fertilizers.



Used syringes (about 3 tons a month) are collected and disposed of by third-party qualified waste disposal agency. Used packaging materials at feed mills are collected and sold to waste collection companies for reuse/recycle.

Air Emissions and Ambient Air Quality: the farms utilizes natural and forced ventilation for odor control at the pig housing, pig pens are elevated allowing air to flow through the housing. The new breeding houses under construction are designed to filter all the air going out so there will be no odor. Breeding farms are located far from local communities in agricultural setting for bio-security reasons. No air emission monitoring is conducted by Yangxiang on a regularly basis.



Pesticide Use and Management: Yangxiang hires professional pest control companies for pest control at its farms and feed mills. For contract farms, market-available pesticides (mainly for controlling mice and flies are distributed by Yangxiang. The list of these pesticides including their active ingredients used by Yangxiang and its contract farms have been provided to IFC and none of them are WHO Class 1a and 1b chemicals.

Community health and safety: As Yangxiang’s breeding farms and contract farms are isolated from human settlements for bio-security reasons, its activities generate limited impacts to local communities. Furthermore, Yangxiang has built its own access roads in some instances (in Yajishan) to further minimize impacts to local communities. The main impacts from its activities to local communities are related to traffic transporting piglets and hogs to and from contract farms, and delivering feed and raw materials to and from the feed mills. The typical transportation distance for piglets is 150km. Drivers are trained and with proper licenses. Related safe driving procedures are developed. No complaints have been received so far from communities around Yangxiang’s contract farms.



As part of the ESAP, going forward Yangxiang will be required to proactively manage its engagement with local communities, especially with respect to its operations in contract farms. Trucks transporting piglets and hogs should display visible signs to facilitate communications in case of any concerns/complaints from the community. Visible signs should also be displayed at the entrance of contract farms.



Security: Yangxiang hires guards to control access to its farms. The guards are not armed. Records show no known complaints against Yangxiang’s guards having been filed.



Community exposure to disease: farm workers are required to follow strict quarantine procedures when accessing the farms. All vehicular access to, and movement within farms, requires passage through dips. These procedures are strictly followed for bio-security reasons, thus minimizing the risks to community exposure to disease.

PS6 is only triggered in relation to para. 26-29 under this PS (the requirement to obtain credible certification to standards pertaining to sustainable management of living natural resources). Yangxiang had obtained in 2014 China GAP certification for one of its pig breeding farm in Guangxi (expired in March 2015). As part of the ESAP, going forward Yangxiang will be required to obtain credible certification to standards pertaining to sustainable management of living natural resources for its primary production activities as they relate to animal husbandry.

Stakeholder Engagement
Yangxiang interacts with local communities mainly through employment of farm workers (who are drawn from such communities), and through its engagement with contact farms. Based on the EIA requirements, neighboring communities are surveyed to receive their feedback/concerns on any new projects/expansions Yangxiang plans to undertake. The copies of such surveys and their results have been reviewed by IFC and records show that the majority of the communities surveyed were/are in favor of Yangxiang’s new projects.

Yangxiang does have a website (http://www.yangxiang.com) and donates from time to time to local charity causes. It presently doesn’t have a formal policy and procedure to proactively engage communities/stakeholders. As part of the ESAP, Yangxiang will be required to develop a stakeholder engagement policy and process to receive feedback/concerns from communities.
