Working Conditions and Management of Worker Relationship
Human Resources Policies and Procedures. ASDI has well-established local versions of Danone Group corporate human resources management system with various internal regulations and procedures that cover core HR issues, including recruitment, training, working conditions, performance evaluation, social benefits, disciplinary actions and dismissal. All legal registrations & procedures of employment contracts, social security & income tax are issued and executed legally up to date.
Working Conditions and Terms of Employment. ASDI currently employs 71 people and will plan to hire an additional 15 after commissioning of the 3rd production line under the proposed Project. All employees are registered under national security system according to KRG legislation. The HR Manager reported that she did her best efforts to employ women, such as meeting with related NGOs and governmental agencies and implementing a clear non-discrimination policy is in place. Nevertheless, the current number of women employed is low. The HR department in the head office oversees general employment policies and procedures under the guidance of HR Manager. The base salary payment for the plant is above the national minimum wage. Other benefits are provided, including private health coverage (including dental and optical needs), performance bonus, extra hours payment, transport, subsidized meals, annual leave and public holidays, etc.
Workers’ Organizations. Currently there are no worker’s associations or trade unions established in ASDI as the plant has been recently commissioned. However, the Company stated that it does not prohibit establishment of such associations as the Danone Group level HR policy includes an explicit reference to freedom of association. Non-discrimination, equal opportunity, worker’s grievance mechanism and OHS provisions will be integrated into the local version of the HR policy and be available in local (Kurdish) language. Direct employees and contractor workers will be informed of this policy in line with local law and IFC’s PS2 requirements, as indicated in the ESAP.
Non-Discrimination and Equal Opportunity. Company HR’s manager stated that there is no discrimination on the basis of personal beliefs, sex or characteristics unrelated to inherent job requirements. The current workforce includes representatives from various communities, including Kurds, Arabs, Turkish, Egyptians and Pakistani,.
Retrenchment. ASDI does not anticipate a reduction in the current workforce; in fact the project will create new employment opportunities thus will increase the overall employment figure at the facility by 25 percent. However, if becomes necessary in future, ASDI will prepare a retrenchment plan based on consultations with the affected workers, the workers’ labor unions and in accordance with local Labor Codes and IFC’s PS2 requirements.
Grievance Mechanism. The Company does not have a fo
rmalized worker’s grievance mechanism although the open door policy allows employees to raise and register their concerns with the management team. Going forward, as set forth in the ESAP, a grievance procedure, for the Company employees, to express their grievances and protect their rights regarding working conditions and terms of employment will be established as per IFC’s PS2 requirements. Direct employees as well as construction and installation contractors and service provider workers will be made aware of the grievance mechanism procedure during the induction training session.
Protecting the Workforce: The minimum age of employment is 18 at the plant. There is no use of child labor and/or forced labor.
Occupational Health and Safety (OHS): As the plant of ASDI has recently been commissioned into full commercial operation, while HACCP awareness and good hygiene practices session have started, progress in EHS training is relatively limited to date. Each new employee goes through an induction program including EHS awareness: in time this will be revised to focus on specific workplace/job risks and hazards. ASDI has already a risk assessment procedure and will perform risk assessments after start up. Risks observed during the site visit included slippery floors, work at height, chemicals, stand-alone workers, machine guarding, truck loading and unloading, confined spaces and ammonia storage (refrigerant). OHS Procedures and instructions related to above mentioned subjects are in place in English. These documents will be translated into local language, as indicated in the ESAP.
The dairies’s refrigeration systems, as it is typical in this industry, are based on ammonia refrigerant. Handling and storage practices will be in accordance with industry’s good practices, including the International Institute of Ammonia Refrigeration (
http://www.iiar.org). Amount of Ammonia (NH3) stored is 2 tons. Ammonia detection system is in place and adjusted to 100 ppm sensitivity. Alarms need to be set at the Threshold Limit Value (TLV ) of 50 ppm in accordance with EU and OSHA codes and ASDI will ensure that necessary PPE (Personal Protective Equipment) will be available and ammonia leakage scenario is included in emergency plan as per the ESAP.
Workers Engaged by Third Parties: ASDI does not employ third parties for its operations. For the construction works which was ongoing during the appraisal visit, a Turkish construction company Altero has been contracted. Altero is an experienced construction company, especially on hygienic design and construction of food processing facilities. Proper accommodation, social areas and food service for contractor’s workers was provided on site. ASDI will improve contractor management system in terms of OHS risks (work at height, PPE use, and electrical safety) and develop an Occupational Health and Safety (OHS) Manual for contractors which will be applicable for construction/installation work of the additio
nal processing line, as per the attached ESAP.
Supply Chain. Skimmed Milk Powder (SMP) and Anhydrous Milk Fat (AMF) are the main raw materials which are currently imported from EU based Danone facilities. There is no issue with child labor or forced labor.
