Project Description

This greenfield project consists of approximately US$20 mn investment to construct a steel fabrication plant in the state of Gujarat, near Halol, 45 km north of Vadodara, with an annual capacity of 25,000 tons. The plant will manufacture in roughly equal quantity for transmission & distribution (T&D) projects and metallic support structures for the cylindrical parabolic solar collectors (CPC) and heliostats in concentrated solar power (CSP) projects that will be developed in India. Eucomsa and Comemsa, both existing Abengoa companies with steel fabricating plants in Spain and Mexico, will provide expertise and know-how, taking advantage of synergies between Inabensa Bharat Pvt. Limited (IBPL or the Company) and existing operations.

Overview of IFC's Scope of Review

For the environmental and social appraisal of this project, IFC specialist undertook interviews with senior executives of IBPL and visited the site of the proposed plant near Halol in the state of Gujarat. The Company completed IFCs environmental and social questionnaire and furnished additional information and documentation to supplement the data provided

E & S Project Categorization and Applicable Standard

While all Performance Standards are applicable to this investment, IFCs environmental and social due diligence indicates that the investment will have impacts which must be managed in a manner consistent with the following Performance Standards. If IFCs investment proceeds, IFC will periodically review the the project’s ongoing compliance with the Performance Standards

While all Performance Standards are applicable to this investment, IFC’s environmental and social due diligence indicates that the investment will have impacts which must be managed in a manner consistent with the above Performance Standards (dated January 2012):

The land for this greenfield project is of recent acquisition but it was a willing-buyer-willing-seller sale and it did not involve resettlement of any kind, therefore PS5 does not apply. Similarly, there are no natural habitats, indigenous peoples or cultural property in or around the proposed facility and thus PS6, PS7 and PS8 do not apply.

This is a category B project according to IFC’s Procedure for Environmental and Social Review of Projects because a limited number of specific environmental and social impacts may result that can be avoided or mitigated by adhering to generally recognized performance standards, guidelines or design criteria. Key E&S issues reviewed during appraisal include: management of environmental, health and safety performance at ongoing operations and during the construction of the new production lines; water and energy efficiency of the production processes; air emissions from combustion facilities and metal cutting, forming, welding and finishing processes; waste management; treatment and discharge of liquid effluents; and life and fire safety, including emergency preparedness and response. Labor conditions, occupational safety and community safety were also reviewed as is described in the following sections.

Environmental and Social Mitigation Measures

Environmental and Social Assessment and Management. IBPL is a subsidiary of Abengoa, a company with extensive experience in the design and manufacturing of galvanized steel structures and with a good EHS record worldwide. The proposed IBPL plant in Halol follows the layout of a similar plant in Mexico for Comemsa, which IFC apprised in March of 2011. IBPL undertook an environmental and social assessment of the proposed Project as required by law. The Company is developing an integrated management system to include policies and procedures for quality assurance, environmental and occupational health and safety management consistent with international standards to be certified compliant with the requirements of ISO 9001, ISO 14001 and OHSAS 18001.
Organization. IBPL is currently developing a team to manage quality, environment and occupational health and safety, as well as corporate social responsibility at the new fabrication plant. These activities will be led by an EHS manager who will report directly to the Plant Manager. Throughout the world the Company provides regular training to employees in a number of areas according to their roles and responsibilities, and this will be replicated at this plant. Training areas include: quality, environment, safety and emergency response. In addition, the Company has a number of activities focused on the development of personnel and support to the workers’ families.

Community Engagement. Whilst the proposed IBPL plant will be located in an industrial area, not far from it there are several communities that the Company will engage to identify and address their social needs and to adequately address any grievances that may arise with the construction and operation of the new fabrication plant.

Monitoring and Reporting. In the same fashion as Comemsa in Mexico, the Company will set up monitoring programs for operational efficiency, quality, environment, and occupational health and safety. The corresponding data will be reported to the authorities as appropriate. Comemsa’s website provides information on the company background, operations, quality, and sustainability issues, which will also include the IBPL plant near Halol.

Emergency Preparedness and Response. During operation IBPL will have emergency preparedness and response procedures in place with fire prevention equipment and trained life and fire safety brigades consistent with international good practice. The Company undertakes regular fire drills where fire extinguishers are used up completely and fully refilled.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. Since 2012, IFC's Financial Intermediary clients applying the Performance Standards are required to develop External Communications Mechanisms to receive and review inquiries or complaints from any interested party regarding the E&S risks and impacts of their operations.

For IFC projects that are active or under consideration, individual(s), or their authorized representative(s), who allege they have been or will be adversely affected by E&S risks or impacts arising from IFC's clients' business activities, may submit a complaint to IFC directly for consideration. When receiving an E&S complaint, IFC engages with complainants and works with its clients to find solutions to E&S concerns as quickly and efficiently as possible.

IFC complaint response is separate from and complementary to IFC’s clients’ project level grievance mechanisms and IFC’s Independent Accountability Mechanism (CAO). Lodging a complaint directly with IFC does not, at any time, restrict access to CAO.

Affected communities have unrestricted access to the Compliance Advisor Ombudsman (CAO), the independent accountability mechanism for IFC and MIGA. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
