Project Description

Jambyl Cement will build, own and operate a greenfield cement plant with a capacity of about 1.1 million tons per year of cement, to be located in Mynaral, approximately three kilometer West of the Balkhash lake in Kazakhstan on the main road and next to the railway connecting Almaty and Astana.

Overview of IFC's Scope of Review

On June 30, 2008, this ESRS was updated to include the ESIA in the local Russian language.

IFC specialists have visited the Jambyl Cement plant and quarry sites, as well as the surrounding areas. The project documentation prepared by Vicat Kazakhstan Cement and its consultants, in particular the local ESIA documentation, the quarry documentation, and the background environmental data has also been reviewed in details. Further, meetings have been held with the Vicat’s technical organization at Ile d’Abeau, nearby Lyon, France. An additional environmental specialist follow up visit to the plant and quarry sites, as well as the surrounding areas will be carried out during the month of July 2008. The project documentation prepared by Jambyl Cement and its consultants has also been reviewed and discussed in detail with the company and its technical team. Based on the project description and area surveillance, an action plan has been agreed to ensure the project’s continued performance in compliance with local regulation and IFC’s Performance Standards and environmental, health and safety guidelines.

E & S Project Categorization and Applicable Standard

This project is being reviewed as a Direct Investment according to IFC’s Social and Environmental Sustainability Policy. Based on a review of project information, the following Performance Standards (PS) are found relevant for the project:

- PS1: Social and Environmental Assessment and Management Systems
- PS2: Labor and Working Conditions
- PS3: Pollution Prevention and Abatement
- PS4: Community Health, Safety and Security
- PS5: Land Acquisition and Involuntary Resettlement
- PS6: Biodiversity Conservation and Sustainable Natural Resource Management

Vicat Group, the majority shareholder in Jambyl Cement, is an existing IFC client in good standing with respect to implementation of previous environmental commitments in another country. The proposed project, to be owned and operated by Jambyl Cement is fulfilling all the Performance Standards. With no indication of impacts related to Performance Standards 7 and 8, and only readily mitigated environmental issues under Performance Standards 1 through 6, the project is being processed as a Category B project.

Environmental and Social Mitigation Measures

The sponsor has prepared a comprehensive ESIA and has presented plans to ensure that the proposed project will, upon implementation of the specific agreed measures, comply with host country environmental and social requirements as well as IFC’s Environmental and Social Performance Standards and industry guidelines. The information about how these potential impacts are being/will be addressed by Jambyl Cement is summarized in the paragraphs that follow. An Environmental and Social Action Plan (ESAP) has been agreed to ensure Jambyl Cement’s continued compliance with IFC’s Performance Standards and environmental, health and safety guidelines; this ESAP addresses both past performance, and social and environmental impacts which will arise from the new project.

- PS1: Social and Environmental Assessment and Management Systems:

IFC’s assessment considered the company’s management of its environmental, health and safety performance in the establishment and operation of its facilities; compliance with national and local permitting requirements; and the company’s engagement with local communities regarding environmental, health and safety performance and corporate social responsibility.

Jambyl Cement will, in accordance with the plans, establish an environmental and social management system (ESMS) to ensure ongoing compliance with the environmental, health and safety and social measures and to meet Kazakh legal requirements and IFC requirements as the project develops and becomes operational. Jambyl Cement will also present quarry reclamation plans, in accordance with IFC Environmental, Health and Safety guidelines for new quarries before quarry operations commence. IFC will require that Jambyl Cement’s internal organization be established to comply with the principle of good ESMS practices as reflected in ISO and OHSAS norms. The ESMS will cover all Environmental, Health and Safety and Social policies, procedures and management plans; as well as management plans and performance reports of contractors. A monitoring plan to ensure these commitments are fulfilled in due time will be part of the investment documentation.

Jambyl Cement will have continuous particulate matter, nitrogen oxides, and sulfur dioxide monitoring of the kiln emissions. The particulate, sulfur dioxide and nitrogen oxides monitoring are used to ensure compliance with the local environmental regulations and the IFC industry guidelines on a continuous basis.

Jambyl Cement has prepared an Environmental and Social Impact Assessment (ESIA), as part of the local approval procedure. Based on this documentation (attached to this disclosure in Russian, French, and Executive Summary in English) IFC and Jambyl Cement has developed a detailed ESAP ensuring the project will comply with international standards and will include the following: community engagement and development programs; external grievance mechanism to deal with community concerns and complaints; terms of employment and working conditions for direct and contracted employees, including migrant construction workers; and living conditions at the construction workers camp; internal grievance mechanism; code of conduct for security forces; and impacts in nearby community due to future increase in traffic. As specified in the ESAP, Jambyl Cement will engage, either internal or contracted, a qualified social expert to better assess the social impacts of their operation and optimize the corporation with the closest local villages. This expert will be responsible for the implementation of a management system to manage social aspects and monitor performance.

- PS2: Labor and Working Conditions:

Jambyl Cement is developing a greenfield project and currently employs mostly senior employees as well as contractors. Jambyl Cement will fulfill local labor laws and has further agreed to incorporate the requirements of PS2 into its Human Resources Department once established. A monitoring plan to ensure these commitments are fulfilled in due time will be part of the investment documentation.

As discussed in the ESAP, Jambyl Cement will develop a Human Resources policy and procedures in accordance with national regulations and IFC’s Performance Standards. The Human Resources policy and procedures will specifically include provisions on non-discrimination and equal opportunity, wages and benefits, disciplinary practices, grievance mechanism and adequate working and living conditions. These procedures will be communicated to all employees in an appropriate manner.

Local hiring is an important consideration for Jambyl Cement in order to enhance the benefits for local communities. Jambyl Cement will include local hiring provisions as part of their Human Resources Policy. Jambyl Cement will also discuss with the local authorities if training and capacity building programs could enhance the local job seekers skills to meet Jambyl Cement’s employment standards. Such training and capacity building programs will preferably not only target unskilled workers, but also semi-skilled and skilled positions. During the consultation process Jambyl Cement will clearly state the number of potential jobs for unskilled workers. This will avoid raising expectations that cannot be met.

A Chinese company has been granted the contract for the construction of the production. As part of the ESAP, Jambyl Cement will notify the Chinese supplier of the need to follow a specified code of conduct regarding labor, living and working conditions and healthcare. A labor audit will be undertaken by a qualified auditor after 6 month of the beginning of construction. Jambyl Cement will implement recommendations from the labor audit as per an agreed timeline with IFC. The company will ensure that these requirements are implemented through constant monitoring of compliance with requirements.

The company might contract security, transport and maintenance companies during its operational phase. As specified in the ESAP, the company will include a code of conduct in all new contracts and will develop and implement a system to ensure the code of conduct requirements are being complied with.

- PS3: Pollution Prevention and Abatement:

IFC’s assessment considered the company’s compliance with environmental requirements, optimization of resource inputs, including energy efficiency and waste minimization practices as well as the storage and handling of hazardous materials used in the construction and operations of facilities.

The proposed plant design has low energy consumption, good emission controls with continuous monitoring of key pollutant emissions (particulate, nitrogen oxides, and sulfur dioxide), discharge of waste water treated to comply with the Kazakh regulations and IFC guidelines, and no significant amount of solid or hazardous production waste, except for broken cement bags, canteen, office and laboratory waste, and maintenance wastes (used refractory bricks, lubricants, etc).

The energy efficiency of the kiln operation will result in a highly efficient performance at 760 kcal/kg clinker. Furthermore, additives will be sought for lowering the requirement of clinker in the final cement. The use of blended cement is however not well established in the target markets at this time, and will need to be carefully introduced. With the average content of clinker in the cement being 86%, based on the currently forecasted product mix and the remaining being additives; the final CO2 emissions from a production of up to 1.1 million tons of cement per year will be 919,000 tons CO2. This is equivalent to 835 kg CO2 per tons of cement on average. The fuel source will be coal, as no other fuel source is reliably available.

Particulate emissions will be controlled at the quarrying sites and in the general material handling systems by designs requiring minimal material drops during handling, fully enclosed conveying systems with bag filters installed at all transfer points. Water based dust suppression will be used where evacuation and filtration systems are not practical, such as the road transport within the quarry operations, where no crushing will take place and a water curtain at the crusher feeding chute at the plant area. At the cement plant all operations will be fully equipped with particulate emission control systems. These systems will be based on bag filters and recycling of the captured materials to the feed stock for the kiln. All bag filters will be designed for maximum emissions of 30 mg particulate/Ncm and the single ESP filter, at the clinker cooler is designed for 50 mg particulate/Ncm. This is in accordance with the IFC guidelines and the local requirements.

Sulfur dioxide emissions will be low, as the alkaline conditions in the kiln will result in the absorption of the majority of the sulfur entering the systems either through the raw materials or the fuel. The sulfur dioxide emissions will be kept below the local requirements and the IFC guidelines value of 400 mg/Ncm.

Formation of nitrogen oxides is caused by fuel burning at high temperatures in the kiln. To minimize the formation of nitrogen oxides the kiln will use advanced burning principles, including the usage of low-NOx burners, which by controlling the flame shape is able to ensure a relative low core flame temperature. By applying these techniques the NOx emissions will be kept below the 600 mg/Ncm, as stipulated in the IFC guidelines. With these well controlled air emissions and the current clean air quality the ESIA conclude tat there will be no ambient air quality problems.

The process used at the project is based on dry technology and the water needs will therefore be limited. The limited water needs will be served by an intake from the nearby Balkhash lake. A sewage treatment plant will be constructed to cater for the waste water produced by the plant and the colony to be established to house foreign construction workers. This sewage treatment plant will treat the waste water to be suitable for used as greenbelt irrigation or release to an evaporation pond. There will be no discharge to the Balkhash lake.

The solid and hazardous waste can either be sold (used refractory bricks) or handled by authorized waste handlers. Ordinary domestic waste (including broken cement bags) will be disposed in approved local landfill operations based on agreement with the local authorities or recycled.

A detailed quarry reclamation plan will be kept current during the lifetime of the project. The plan will include the contouring of the quarry landscape, to be developed as part of the quarry operation. The quarry land and its surroundings are barren and rehabilitation can therefore only include the appropriate contouring to minimize the visual impacts.

- PS4: Community Health, Safety and Security:

IFC’s assessment considered the company’s operations with regard to the impacts of the construction and operations of facilities, including: movement of vehicles to and from construction sites, operation of construction equipment, containment of dust, noise and other nuisance factors.

The new production facilities will all be operating according to sound pollution control principles, and the project will comply with the IFC Performance Standards and the IFC guidelines. The current air quality is very good and no significant degradation of the air shed is foreseen.

To ensure proper management of potential community issues related to interaction with migrant workers, the ESAP is stipulating a series of actions agreed to eliminate or minimize negative impacts.

Jambyl Cement’s new operations will be located with direct access to the main road infrastructure connecting Almaty and Astana. It will further be directly linked to the main rail system, also connecting these cities. To minimize the increase in traffic due to the new facilities, the company is planning to use the rail system for all major imports of raw materials (e.g. coal and additives) as well as for the main transport of the final product (cement).

Armed security personnel will likely be present at the plant and quarries. As indicated in the ESAP, the company will include a code of conduct on each contract based on the UK voluntary principles on security or similar and will ensure training is provided to all security personnel and supervisors. Jambyl Cement will monitor compliance with the stated principles and investigate any incident to be able to take action to prevent recurrence.

- PS5: Land Acquisition and Involuntary Resettlement:

The Company has acquired the land for the plant and the quarries, as well as the needed land for connecting and access roads, and right-of-way for utility lines. Due to its remote location and the barren nature of the land in the region it has been possible to completely avoid the taking of land previously or currently used by others.

- PS6: Biodiversity Conservation and Sustainable Natural Resource Management:

The ESIA and IFC’s assessment considered the impact of the project on the local biodiversity. The biologists who carried out the initial ESIA study has concluded that the plant and quarry sites avoid any critical habitats and that it is highly unlikely that any endangered flora or fauna will be found on the sites at any time of the year. There will be no discharges to the Balkhash lake and therefore no influence on its biodiversity.

Stakeholder Engagement

Vicat is new to the project area and has therefore no previous history of interaction with the local population. In order to manage community and external stakeholder relations and concern, and in accordance with the ESAP, Jambyl Cement will implement a grievance mechanism in compliance with IFC performance standards and implement a Community Engagement and Development Plan to ensure an effective relationship with the nearby community. Jambyl cement will carry out a local disclosure in parallel to IFC’s disclosure, and will in accordance with the ESAP carry out ongoing disclosure as part of the community relation program to be established.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
