Project Description

The project consists of:

- the modernization and expansion of Marina Market’s retailing and warehousing facilities in Burkina Faso;
- the construction of a retail/office building and of a supermarket in Ghana; and
- the expansion of Marina Market’s retailing and warehousing activities in Niger.

Overview of IFC's Scope of Review

IFC’s review of this project consisted of appraising technical, environmental and social information submitted by the project Sponsor including a review of:

- the design drawings for the building in Accra, Ghana, particularly with respect to the provisions for fire and life safety;
- the review by the Ghana Fire Service of the provision for fire suppression at the Accra, Ghana site; and
- written answers to questions put to the Company by the IFC team

The IFC social and environmental team visited the project site in the Airport area of Accra, Ghana, as well as the Accra municipal facilities for wastewater treatment. During the site visit, IFC interviewed the responsible architect and carried out a visual inspection of the site. The IFC social and environmental team has not been able to visit the two other sites in Ouagadougou, Burkina Faso and Niamey, Niger, but has received information from the Company with respect to these sites.

E & S Project Categorization and Applicable Standard

While all Performance Standards (PS) are applicable to this investment, IFC’s environmental and social due diligence indicates that the investment will have impacts which must be managed in a manner consistent with the following Performance Standards:

- PS 1: Social and Environmental Assessment and Management
- PS 2: Labor and Working Conditions
- PS 3: Pollution Prevention and Abatement
- PS 4: Community Health Safety and Security

Land for all sites has been acquired through a willing buyer-willing seller transaction. The site in Accra is in an area of general commercial development, including hotels and other office buildings. Thus, PS 5 on Involuntary Resettlement and Land Acquisition does not apply. All of the sites are within developed urban areas with no natural habitat, so PS 6 does not apply. Also because the sites are in urban areas, PS 8, Cultural Heritage, does not apply. There are no Indigenous People, as defined for the purposes of PS 7, in the areas around the project sites, so this Standard does not apply either.

The project involves small, greenfield developments in urban areas. The key social, environmental, health and safety impacts associated with the project will include:

- social and environmental management of the projects;
- employee occupational health and safety;
- management of solid waste; and
- life and fire safety.

Because the mitigation measures can be readily designed and managed, adverse impacts are not expected to be diverse or irreversible and will be limited to project site, and no physical or economic displacement of communities occurred, according to IFC’s Procedure for Environmental and Social Review Procedure, the project has been classified as a Category B.

Environmental and Social Mitigation Measures

IFC's review of this investment identified the following environmental, social, health and safety issues:

- social and environmental management system;
- corporate human resources policy;
- employee safety and training;
- sewage and liquid waste treatment;
- solid waste disposal;
- water and power supply;
- fuel storage;
- tenant operations;
- emergency response preparedness; and
- independent fire safety master plans.

The sponsor has presented plans to address these impacts to ensure that the proposed project will, upon implementation of the specific agreed measures, comply with the environmental and social requirements - the host country laws and regulations and the World Bank/IFC social and environmental Performance Standards and environmental, health and safety (EHS) guidelines. The information about how these potential impacts will be addressed by the sponsor/project is summarized in the paragraphs that follow. Further information is provided in the attached documentation.

- PS1: Social and Environmental Assessment and Management Systems

Marina Market is made up of three separate companies, one for each of the countries in which it operates (Burkina Faso, Ghana, and Niger). Marina Market does not currently have a person in any of the three countries who is designated to carry out social and environmental assessments of their projects. Marina Market will designate one person in each of the three companies to take responsibility for management of social and environmental issues. One of those people will be responsible for ensuring that all construction and on-going operations in all three countries meet country laws and IFC’s Performance Standards. Marina Market’s primary interaction with local communities is through the customers who shop at their supermarkets or in their malls. Marina Market will develop annually an environmental and social action plan (‘ESAP’), which will report on (i) progress made on items contained in the previous year’s ESAP and (ii) new items identified during an annual review of the social and environmental aspects of its operations. This ESAP will be made publicly available in the individual stores and office buildings.

- PS2: Labor and Working Conditions

Marina Markets will develop and implement a human resource policy acceptable to IFC for each of the three local companies. These policies will take into account the respective differences in local law among the countries. For construction, Marina Markets uses casual labor, which is provided with appropriate protective gear, including hardhats and hearing protection. But the protective gear is not consistently used. Marina Market will require that the protective equipment is used by all workers on its sites.

- PS3: Pollution Prevention and Abatement

In Accra, the building will use power off of the national grid and water from the city’s water supply. Because of recent power shortages in Ghana, the company has had to use its back-up generator (75 kVa) more frequently. The national government is addressing the shortages and it is likely that the back-up generator will return to infrequent use within the next few months. Sewage goes into the Accra municipal system, which does treat it to national standards. Solid waste goes to a municipal facility. This facility is being developed with the assistance of the World Bank, but is the subject of a World Bank inspection panel complaint. IFC is reassured, however, that the complaint is not a result of the actual performance of the facility. Sewage treatment at the sites in Burkina Faso and Niger, which involve small amounts of domestic wastewater, will include grease traps and primary septic. Solid waste management in these countries will be addressed through programs to find ways to minimize waste going to the municipal facilities and to increase the amount of recycling. Fuel tanks for all sites will have concrete containment walls and impermeable bases to prevent spillage.

- PS4: Community Health Safety and Security:

All facilities will have their fire and life safety provisions reviewed by an independent fire safety specialist in accordance with acceptable international standards. Life and fire safety master plans will be developed for all facilities, and the office building and mall in Ghana will have an emergency response plan prepared in cooperation with the Ghana Fire Service.

Stakeholder Engagement

The client will make this ESRS and the accompanying Corrective Action Plan available in public places for a period of 30 days. On an annual basis, Marina Market will make publicly available an ESAP for each one of its facilities funded by this project.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. Since 2012, IFC's Financial Intermediary clients applying the Performance Standards are required to develop External Communications Mechanisms to receive and review inquiries or complaints from any interested party regarding the E&S risks and impacts of their operations.

For IFC projects that are active or under consideration, individual(s), or their authorized representative(s), who allege they have been or will be adversely affected by E&S risks or impacts arising from IFC's clients' business activities, may submit a complaint to IFC directly for consideration. When receiving an E&S complaint, IFC engages with complainants and works with its clients to find solutions to E&S concerns as quickly and efficiently as possible.

IFC complaint response is separate from and complementary to IFC’s clients’ project level grievance mechanisms and IFC’s Independent Accountability Mechanism (CAO). Lodging a complaint directly with IFC does not, at any time, restrict access to CAO.

Affected communities have unrestricted access to the Compliance Advisor Ombudsman (CAO), the independent accountability mechanism for IFC and MIGA. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
