Project Description

Teylium International (Teylium, the Group and the Sponsor) is a diversified holding company with a commercial property development arm and operations in Senegal, Cote d’Ivoire, Mali, Guinea and Cape Verde. Teylium has requested IFC to provide up to EUR 17 million of debt for:

- the greenfield construction of a 180 room, five-star hotel to be operated by Radisson and fully-owned by a Teylium International subsidiary, Chain Hotel SA (the "Chain Hotel”); and
- the greenfield construction of a 20,000 sqm, mixed-use facility (including a shopping mall, a commercial center and residences) fully owned by another Teylium subsidiary, Sea Plaza SA, ("Sea Plaza").

The hotel is slated to open at the end of the second quarter of 2008 and the shopping center at the end of the fourth quarter 2008. The project will help promote the modernization of the hotel, retail and commercial property development in Senegal and also support the growth of local sponsors in West Africa.

Overview of IFC's Scope of Review

IFC has review the following Environmental Impact Assessment for the project, which will be publicly released through the InfoShop:

- Simon et Christiansen Afrique Ingenieurs-Conseils SARL. Etude D’Impact Environnemental pour la Construction du Complexe Sea Plaza Hotel : Rapport Final 08.01.2007. (Environmental Impact Study for the Construction of the Sea Plaza Hotel Complex: Final Report (“the EIA”) Dakar : Teylium International.

IFC has reviewed the following additional documents that will not be made publicly available:

- Letter from the Director of the Environment and Classified Establishments in the Senegalese Ministry of the Environment, Nature Protection, Reservoirs and Artificial Lakes, dated 03.10.2007 attesting that the EIA conforms to the Senegalese Environmental Code relating to environmental impact studies.

- Bureau Veritas. Notice de Securite des Personnes (Notice of Security of Persons): Hotel Sea Plaza « Batiment en 4 Niveaux », Notice de Securite No CTC 16495 SMK/AS Du 05/03/2007.

- Letter from the Commander of the National Taskforce of Firefighters, dated 19.03.2007 to the Chief of the Division of Infrastructure for the National Agency of the Islamic Conference Organization concerning the “Etude Technique d’un dossier de construction d’un Establissement Recevant du Publique” (Technical Study of a construction project for a Public Building).

An IFC social and environmental specialist has visited the site on the West Corniche of the City of Dakar, Senegal, and has had discussions with the Ministry of the Environment, Institut Africain de Gestion Urbaine (‘African Institute for Urban Management’), the Project environmental consultant, the World Bank urban sanitation specialist based in Dakar, Office National de l’Assainissement (“ONAS”), near-by local residents, other local environmental consultants, and with the Sponsor. The Corniche is a road that runs around the edge of the peninsula on which the City of Dakar sits. IFC staff have also visited the wastewater pumping station operated by the “ONAS”, the national agency responsible for water treatment. Additionally, the staff of Teylium International, (the Sponsor) has answered written and oral questions for IFC staff.

E & S Project Categorization and Applicable Standard

While all Performance Standards (PS) are applicable to this investment, IFC’s environmental and social due diligence indicates that the investment will have impacts that must be managed in a manner consistent with the following Performance Standards:

- PS 1: Social and Environmental Assessment and Management Systems
- PS 2: Labor and Working Conditions
- PS 3: Pollution Prevention and Abatement
- PS 4: Community Health, Safety and Security
- PS 5: Land acquisition and Involuntary Resettlement

According to the EIA, the site lacks substantial natural vegetation and has no cultural heritage sites. PS 6 Natural Habitats and PS 8 Cultural Heritage do not apply. There are no people who would be considered as Indigenous Peoples under PS 7 Indigenous Peoples living near the project site.

The key social and environmental issues for this project are:

- Environmental assessment,
- Wastewater treatment, and
- Fire and life safety.

The project itself will have a limited impact on the surrounding urban environment. The EIA has addressed the significant environmental aspects of the projected and recommendations have been incorporated into the design of the project. The additional measures requested following the IFC review will use known and accepted technologies and procedures to avoid or mitigate social and environmental impacts. Thus, this project is a category B under IFC’s Environmental and Social Review Procedures.

Environmental and Social Mitigation Measures

PS 1: Social and Environmental Assessment and Management Systems

Environmental Assessment. A technical committee has reviewed the final EIA (dated September 2007), as Senegalese legislation requires, and declared it compliant with Senegalese environmental legislation regarding impact studies.

The Chain Hotel, currently under construction, is located on the West Corniche in the Fann neighborhood of Dakar. Local authorities drafted a development plan for the West Corniche in 2004 that includes, according to the Project EIA: enlargement of the sea side road, construction of a memorial to victims of the Diola shipwreck, and the construction of 7 luxury hotels. The main objective of this new development is to provide the city with a set of luxury establishments in time for the Islamic Conference of March 2008, and the entire project is being coordinated by ANOCI (Agence Nationales de l’Organisation de la Conference Islamique). The road, memorial and two of the hotels are currently under construction. No global EIA has been done for this overall development of the West Corniche.

The West Corniche development, particularly road construction has required traffic diversions onto densely populated local roads with attendant increase of noise, dust, potential for traffic accidents, and run-off of sediment-laden water to the sea. Road diversions have removed passing trade from shops located on the Corniche. These impacts arise from the Corniche development as a whole; the Project did not cause the road diversions, and the runoff from the Project construction site is insignificant compared with any impacts from the road construction (though see below about managing site run-off). The Project’s contribution to any cumulative impacts is minimal and the major issues are outside the Sponsor’s control.

Management Program and Organization. For the construction phase, the Sponsor has developed a project specific procedure on health and safety (“Plan particulier de securité et de protection de la santé”) that is being adequately implemented. The EIA does provide for an Environmental Management Plan for the construction phase. The Project environmental consulting firm is providing regular reports to ANOCI. During construction, the site manager is responsible for health and safety on the site. For the remaining period of construction, this site manager will also be responsible for reviewing monitoring reports sent to ANOCI, identifying needed corrective actions, and ensuring that they will be carried out. During operation, the Sponsor will ensure that there is a person designated to take responsibility for management of social, environmental, health and safety (SEHS) issues. This person may either work for Radisson – the company managing the hotel - or for the Sponsor.

Radisson will operate the hotel for the Sponsor. Radisson is contractually bound to operate the hotel according to Senegalese law, including the EIA. Radisson is part of the Sustainable Tourism Partnership of the International Business Leaders Forum. The Tourism Partnership sets minimal standards for sustainable hotels that include designating a person to be responsible for social and environmental management, staff training, monitoring of environmental performance, and community engagement. Fulfillment of these principles, when combined with IFC standards and guidelines, will ensure acceptable management of the hotel.

Community Engagement. The company has carried out the consultation mandated by Senegalese legislation. This included public meetings that were announced in the newspaper. These consultations have met the requirements of PS 1.

Monitoring. As indicated above, monitoring of H&S performance during construction will be integrated into construction and management. On environmental issues, monitoring is carried out by ANOCI, who has subcontracted it to SECPI. SECPI does regular inspection and reports monthly to ANOCI. The Ministry of the Environment has visited the construction site several times and only found minor issues that were then corrected. During operation, the hotel will monitor health and safety, energy and water use, potable water quality and liquid effluent.

Reporting. During the remaining period of construction, reports on environmental performance will go to the site manager, who currently also receives reports on health and safety. As mentioned, during the operational phase, a designated person will be responsible for managing environmental, health and safety issues, this person will also be responsible for reporting to both the managing company, Radisson, and the sponsor on this performance. The company will also annually put together an environmental and social action plan (ESAP), listing items for improvement in the hotel’s performance, with time-bound targets. This ESAP will be made publicly available, including to the surrounding neighborhood, in a culturally appropriate manner.

With the on-going management measures described above, i.e., designation of a person responsible for SEHS issues, monitoring of SEHS performance, and the annual development and public release of an ESAP, the project will meet the standards of PS 1.

PS 2: Labor and Working Conditions

Human Resource Policy. The Teylium Group has a human resources policy and manager. During the operational phase, the Radisson management will apply Radisson’s human resources policies and standards will be applied. For the construction phase, all workers are provided with regular contracts. Six hundred and fifty workers are currently on site, 80% of the current workforce is under long term contract, the other being under temporary contracts.

Worker’s Organizations. Each of the subcontractors on site has its own workers committees and in Senegal in general, workers are well organized.

Protecting the Work Force and Occupational Health and Safety. The implementation of the ‘Plan Particulier de Securité et de Protection de la Santé” (PPSPS dated March 2007) and strict monitoring by the construction coordinator and his safety officer ensure adequate protection of the work force. To date, only minor accidents and no fatalities have been noted. However, security signage is not in place on the site. IFC is requesting that the company provide adequate safety signage for the rest of the construction period (including construction of the mall).

With the addition of worker safety signage on the site, the project will meet the requirements of PS 2.

PS 3: Pollution Prevention and Abatement

Pollution Prevention, Resource Conservation, Energy Efficiency. The project has been designed taking into account resource conservation measures. The hotel will use LED light bulbs for the public areas in decoration lamps, but not in the guest rooms. Waste heat will be recovered from the air conditioning systems for heating domestic water, and will meet 40% of the hotel’s hot water needs. Guest rooms will be equipped with water conservation showers and toilets, as well as keys that turn off the air conditioning and light within the room when the guest leaves. The opening of the veranda window will also automatically cut off the individual air conditioning in the room. With respect to water usage, IFC expects that the hotel will use the global benchmark of .9 to 1 m3 per occupied room per day.

Waste. During the construction phase, solid waste is regularly evacuated to the Mbeubess landfill via a private contractor (Loc Net), and a truck regularly collects liquid hazardous waste for evacuation to SRHU, (Société de recuperation des huiles usages). Workers are using portable toilets with septic tanks that are regularly emptied by truck and disposed in the Camberene wastewater treatment plant. Surface run-off water flows directly to the sea. A decantation basin was planned for in the EIA’s Environmental Management Plan for the construction phase, but was not installed. IFC has requested that the basin be installed, along with an oil separator for both the remaining period of construction and the operational phase. Only a small amount of hazardous material is produced during the construction and is evacuated to the Mbeubeuss landfill.

During the operation phase, solid waste will be collected by a private collector and evacuated to the Mbeubeuss landfill, Radisson standards for waste minimization and recycling will be applied. Liquid hazardous waste derived for vehicle maintenance on site is collected by a private contractor and presumably disposed for recycling at SRHU.

Sewage treatment during operation. The hotel has built a 900m long pipe, at the cost of 260 000 US$ (120 million CFA), to join the ONAS pumping station located opposite the CAD University of Dakar. The CAD pumping station is part of three pumping stations ( Soumbedioune, CAD, Attepa) located along the West Corniche that are all linked to a 230 m long pipe discharging into sea (constructed in 1980). The CAD and Soumbedioune stations lack electricity to be able to pump their discharge to this pipe and, thus, release raw sewage directly at shore level. Only the Attepa station, with its own back-up electricity system, can pump the effluent to the sea. The CAD station also has a decantation and screening system; it is out of order. Given these circumstances, the use of the CAD station does not meet IFC requirements. The Sponsor has agreed, however, to take all necessary actions to meet IFC requirements for wastewater treatment, including building a separate wastewater treatment plant for the hotel, if necessary.

Hazardous Materials. For the electricity back up system, 20,000 liters of fuel are stored on site in an underground tank built to EU standards (double walls and regular automated monitoring for leakages). Seventeen tonnes of gas are also store in an open air, fenced area.

Emergency Preparedness and Response. This is covered during the construction phase by the PPSPS.

With the provision of run-off and wastewater treatment that meets Senegalese and IFC requirements, the project will meet the standards of PS 3.

PS 4: Community Health, Safety and Security

Community Health and Safety. The EIA mentions problems with the stability of the coastal zone: several faults are known in the area and several building near-by were severely damaged by fissures in the 1990s. A South African consulting firm carried out a geotechnical study, and the study’s results were incorporated into the final design. The EIA also mentions coastal erosion: A study has also been commissioned by the sponsor on coastal erosion and results integrated into the design.

A security plan and a fire and safety plan has been prepared and submitted by Bureau Veritas and accepted as compliant with Senegalese regulations in March 2007. The plan follows both French and European Union standards and spells out the features and materials that must be used for the hotel to meet these standards. French and European Union standards meet IFC’s requirement for the application of recognized international standards for fire and life safety. Bureau Veritas undertakes periodic inspections to ensure that the hotel is, in fact, being built to the required standards. IFC will ask for a final inspection of the hotel with respect to life and fire safety prior to its opening to the public.

Security Personnel Requirements. The hotel is currently protected by 14 watchmen. From December 1st, they will be armed. These watchmen work for the security company SACAM, which is recognized in Senegal for having adequately trained personnel.

With the reassurance of a final inspection of the hotel and mall with respect to fire and life safety, the project will meet the requirements of PS 4.

PS 5: Land Acquisition and Involuntary Resettlement

No people were located on the site itself prior to acquisition by the Sponsor for the hotel project. However, Teylium has leased a site next door from a third part to provide a space for its construction management offices. This lease was done under a willing leasor – willing leasee arrangement with the owner. Two people were growing crops on this site. Teylium compensated the people for their crops. Once the project is over, the lease will expire and the people will be able to go back to the site to continue cropping.

This arrangement meets the requirements of PS 5.

Stakeholder Engagement

As required by Senegalese regulation, a public consultation has taken place, following by a public meeting for presentation of the project. During the development of the EIA, a total of 17 local residents were consulted and provided with a questionnaire. A public meeting was carried out on August 7, 2007, which 40 people attended. The public meeting was announced in the press and a leaflet presenting the project was provided at the meeting.

IFC supports its clients in addressing environmental and social issues arising from their business activities by requiring its real sector clients to set up and administer appropriate grievance mechanisms and/or procedures to address complaints from Affected Communities in relation to environmental and social issues arising from IFC's clients' business activities. Since 2012, IFC's Financial Intermediary clients applying the Performance Standards are required to develop External Communications Mechanisms to receive and review inquiries or complaints from any interested party regarding the E&S risks and impacts of their operations.

For IFC projects that are active or under consideration, individual(s), or their authorized representative(s), who allege they have been or will be adversely affected by E&S risks or impacts arising from IFC's clients' business activities, may submit a complaint to IFC directly for consideration. When receiving an E&S complaint, IFC engages with complainants and works with its clients to find solutions to E&S concerns as quickly and efficiently as possible.

Affected communities have unrestricted access to the Compliance Advisor Ombudsman (CAO), the independent accountability mechanism for IFC and MIGA. CAO facilitates the resolution of complaints related to IFC and MIGA projects and sub-projects, undertakes reviews of IFC’s and MIGA’s environmental and social compliance, fosters public accountability for their commitments, and enhances the environmental and social performance of IFC and MIGA.

Independent of IFC and MIGA management and reporting directly to the IFC and MIGA Boards of Executive Directors, CAO helps resolve issues raised about the environmental and social impacts of projects through a neutral, collaborative, problem-solving approach via its Dispute Resolution function. It also reviews IFC’s and MIGA’s compliance with environmental and social policies, assesses related harm, and recommends remedial actions through its Compliance function. Additionally, CAO provides advice to IFC, MIGA, and their Boards to enhance environmental and social sustainability performance and minimize the risk of harm.

Complaints may relate to environmental and social harm regarding any aspect of the planning, implementation, or impact of a project or sub-project, and can be made by any individual, group, community, entity, or other party affected or likely to be affected by the environmental or social impacts of an IFC- or MIGA-financed business activity.
