Project Description
IFC will provide Post Transaction Advisory Services to the Kyrgyz Ministry of Health on the Kyrgyz Dialysis PPP for a period of eighteen months focused on addressing any legal, technical and operational issues and aimed at setting up efficient contract management and monitoring mechanism. In addition, capacity building will be provided on an ad hoc basis to targeted specialists at the MOH dealing with the contract management and to members of the Liaison Committee.
IFC will engage in the following specific activities:
Objective 1: to assist the MOH in assessing the compliance to the PPP contract and in addressing technical and legal issues raised in relation to the contract between MOH and FME;
Objective 2: Building institutional capacity within the MOH to manage and monitor the PPP Agreement in an efficient and constructive manner, including the establishment of effective monitoring procedures.
The team notes that IFC will not support the MOH in litigation matters, and in line with IFC policy in this regard will withdraw in case a conflict arises between the parties that would lead to application for arbitration, litigation, etc. Above legal boundaries will be reflected in the legal agreement between IFC and the MOH.
